In the absence of an eligibility list, the resident director may approve a provisional appointment for a person who meets the minimum qualifications of the class in which the vacancy exists but who has not passed the examination for that class. A provisional appointee must immediately apply for examination and be examined as soon as practical. After certification from an appropriate register and successful completion of six months of active service in the class in accordance with 3.90(2) of these rules, provisional appointees will have completed their probationary period and will have permanent status.

A provisional appointment will not exceed six months and successive provisional appointments will not be allowed.
